By accessing, downloading, loading, running, or otherwise using any model, tokenizer, weights, binaries, firmware packages, software, or related materials provided through TopK (the “Service”), including this browser demo and any ESP32 / edge packages (collectively, the “Models”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use & Model License (the “Terms”). If you do not agree, do not use the Service or the Models.
The Service is operated by the individual operator of TopK (“Operator,” “we,” “us”). These Terms are a binding agreement between you and the Operator. No corporate entity is required for this license to apply.
Subject to your continued compliance with these Terms, the Operator grants you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Models solely to evaluate and interact with the Service for your own internal, non-commercial experimentation and demonstration purposes. No other rights are granted, whether by implication, estoppel, or otherwise. All rights not expressly granted are reserved by the Operator.
The Models, weights, tokenizers, architectures, training artifacts, prompts, packaging formats, documentation, branding, and all related intellectual property remain the exclusive property of the Operator (and/or its licensors). Accessing or downloading a Model does not transfer ownership, title, or any IP rights to you.

Models may run locally in your browser or on edge hardware you control. Local execution does not expand your license. Any copy cached by your browser, device, CDN, or network remains subject to these Terms and must be deleted when your license ends or when you stop using the Service.
THE SERVICE AND MODELS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. Model outputs may be incorrect, biased, incomplete, unsafe, or offensive. You are solely responsible for verifying any output before relying on it.
You use the Service and Models at your own risk. To the maximum extent permitted by law, the Operator will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or business opportunity, arising out of or related to the Service or Models, even if advised of the possibility. The Operator’s total liability for any claim shall not exceed the greater of (a) amounts you paid the Operator for the Service in the 12 months before the claim, or (b) USD $50. Some jurisdictions do not allow certain limitations; in those cases, liability is limited to the fullest extent permitted.
You agree to defend, indemnify, and hold harmless the Operator from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or Models, your violation of these Terms, or your infringement of any third-party right.
Inference in this demo is designed to run locally in your browser. Prompts and generations are not intentionally uploaded for model inference. If you join a waitlist or contact us, the email and related metadata you submit may be stored to communicate about products and updates. Do not submit sensitive personal data you are not willing to share.
The Operator may suspend, restrict, or terminate access to the Service or Models at any time, with or without notice, including for suspected misuse. Upon termination, your license ends immediately and you must delete all copies of the Models in your possession or control.
We may update these Terms at any time by posting a revised version in the Service. Continued use after changes become available constitutes acceptance of the updated Terms.
These Terms are the entire agreement between you and the Operator regarding the Service and Models, and supersede prior or contemporaneous understandings on that subject. If any provision is held unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without prior written consent; the Operator may assign them freely. These Terms are governed by the laws of the United States and the State of California, excluding conflict-of-law rules, unless mandatory local law requires otherwise. Courts in California shall have exclusive jurisdiction, except where prohibited.
